Contract Analysis
The purpose of this paper is to provide a contract analysis, and decide whether I should remain conducting business with Marshall, or whether I should sever business ties to proceed with a much larger company that will provide a significant income increase. An analysis of what the pros and cons are from both a legal and spiritual perspective will be discussed throughout the analysis.
Introduction
I met Marshall during a Sunday school session at church. Marshall was a current non-Christian, however he was trying to discover his faith. The first area of discussion and analysis will be based around Christian duties, and going into business with a non-believer. During conversation we discovered that we were each invested in companies that promote and sell health food. I sent some samples to Marshall of my family’s product. Marshall’s customers seemed to have responded very well to the product. Marshall began to order more and more products from my family’s business. My company always ensured to get all products ordered to Marshall in a timely manner, and ensured that the cost remained the same. Normally my company required a payment within thirty days. Marshall usually paid his bill within forty-five to sixty days. Although my invoices show that I can/will charge interest I never enforced this with Marshall. My son was a seventeen year old part-time delivery person. One day my son delivered Marshall his shipment he ordered, and Marshall had my son sign into a company contract without my son really understanding what the document contained. Neither my son nor Marshall informed me of the document being drawn up and signed. A well-known newspaper wrote an article on my families product, and before we knew it the business began to have so many requests that my company could not keep up with the demand.
