Role and Functions of Law
The function and role of law in business and society require an understanding of the definition. According to Melvin (2011), “Law is a body of rules of action or conduct prescribed by controlling authority, and having legal binding force”, (pg. 4). Throughout this paper it will discuss the roles of law in business and society, judicial reviews, the difference between federal courts and state courts and the laws and regulations. It will also explain the role of law in my pervious retail job.
Role and Functions of Law
There are several differences between the federal court structure and the state’s court structure. According to "United States Courts" (2014), “The federal court system uses Article III of the Constitution invests the judicial power of the United States in the federal court system. Article III, Section 1 specifically creates the U.S. Supreme Court and gives Congress the authority to create the lower federal courts”. The state court system uses the Constitution and laws of each state to establish the state courts. A court of last resort, often known as a supreme court, is usually the highest court in a state. Another difference is that if a party of the Federal Courts are dissatisfied with a decision of the U.S. district court can appeal to the U.S. court of appeals. If the state court is dissatisfied with a decision made they can take their cases to the intermediate court of appeals. Judges are each selected differently as well, the Federal Court judges are selected by the President of the United States whereas the State Court judges are selected in different ways such as elections or appointment for given number of years.
