Strengths and Weaknesses There were many weaknesses the respondent Steve Jones had. It was extremely clear that he was not very well prepared or organised because he did not bring vital documents. He had forgotten to bring the criteria for the matrix system and did not have the document which recorded the scores for both employees for each section. This meant the judge could not really analyse whether the scoring was fair so the scoring system was rejected and the tribunal refused to take it into account. This definitely affected them from winning the case as they had no real evidence which could be backed up. The respondent struggled to find the correspondence of his statement in response to the defendants witness statement leading to a lot of time wasting. The judge was getting impatient and said “It would help everybody if you were clearer about where you were going” The majority of Steve’s paperwork was mixed up and consisted of errors. In comparison one of the strengths of the respondents was that Sarah Hills was organised as she noted down also the dates and times for the attendance and punctuality. However she was too over confident which did not really do her any favours as she continuously interrupted and at times spoke rudely to the opposition. The judge had to be quite firm with her. A positive aspect was that both managers supported each other which showed a joint decision. Claire presented herself well and was very patient and she did not interrupt. She also spoke clearly and confidently communicating effectively in a respectful and calm manner. She challenged the opposition strongly with confidence making good points asking how downturn in business could affect him when they worked on a day-to-day basis not monthly. Steve’s responses were not strong enough as most of the time he did not relate to the question and repeated the same thing.
