For the simulation, I chose to specify Contracts for the International Sale of Goods for law and International Arbitration to resolve any contract disputes before WTO membership was gained and I chose the same two after WTO membership. A dispute resolution clause should also be put into place, just in case there are any cases which already state which method of resolution is to be taken.
There is a certain set of issues that can arise from resolving legal disputes on international transactions because there are two governments to take into account and each may have different laws and stand points, given the situation. A law from a foreign country won’t hold up in the U.S. court system and a U.S. law won’t hold up in a foreign land. These are always things that need to be taken into consideration when taking legal action against a foreign business partner based in a different country.
Factors that could actually work against CadMex’s decision to grant sublicensing agreements is that if there is any negligence from a third party, the main company is liable and lawsuits could ensue. This could be something as simple as a worker damaging property or doing anything outside of the agreement. That’s a big risk to take.
When the local customs and laws conflict with the customs and laws of an organization operating abroad, the laws and customs of where the business is located should prevail before anything else because the company must abide and comply with the laws in the land and jurisdiction they are currently in.
There is a big different between the issues in this simulation and the domestic legal issues discussed prior. Domestic legal issues only need to worry about complying with one set of laws and coming to a conclusion from those. In international legal...
