According to University of Phoenix (Legal Environment of Business) Alumina Inc was reported to be in violation of environmental discharge. Five years ago, during a regular compliance inspection, Alumina was found to be in violation of environmental discharge norms due to high levels of PAH (Polycyclic Aromatic Hydrocarbon). Following this discovery, the EPA ordered a clean up and Alumina was found to be in compliance during subsequent inspections. However Kelly Bates managed to threatened Alumina’s good overall environmental compliance record by filing a million dollar personal injury law suit against Alumina Inc to recover punitive and compensatory damages, stating Alumina was in serious violation of environmental laws which caused her daughter’s leukemia. The objective here is to manage crises arising out of these environmental allegations and to prevent extensive losses, and be in compliance with environmental laws and statues. In order for Alumina to be a responsible, respected company and avoid possible lawsuits and certain tort liability it must meet the requirements of environmental laws. One way to go about this is to make sure the company is in compliance with the Clean Water Act. According to EPA, “The Clean Water Act (CWA) is the cornerstone of surface water quality protection in the United States. (The Act does not deal directly with ground water nor with water quantity issues.)
