In this particular scenario we have a woman named Shannon who was given some pain medication, but was insisted from her physician to not drive after taking the medication because it could induce drowsiness; which means she can feel sleepy during her day. The big issue with this scenario is that Shannon took the medication in spite her doctor's warning, and she (Shannon) drove while being on the mediation. Now because Shannon is driving on this medication, she fails to stop at a traffic light and crashes into another vehicle, causing the passenger in the vehicle that Shannon hit to be seriously injured.
In this case the plaintiff would be the passenger in the vehicle that was struck by Shannon, because he/she sustained serious injuries due to the accident. This means this will be heading to court by the plaintiff (the passenger) by sending out a lawsuit out the defendant, which is going to be Shannon in this case. The reason why Shannon is the defendant is because she was the one who failed to stop at a traffic light which is a red light and the law states that you must come to a full stop at a red traffic light. Now because Shannon didn't stop at this red light, she smashed her vehicle to the plaintiff's car.
This case will be heard in State court because the accident happens in the state. Also in the passage of this analyze of this case it doesn't say anything about where the injured passenger lived at (meaning state), so I’m going to state that he/she lived in the same state as Shannon, but if it was a different state's then it would be federal court. This lawsuit will be a civil lawsuit brought into the state court. The jurisdiction over this cause of action would go to the state Supreme Court because this is dealing with state matters and state laws and the jurisdiction will be general jurisdiction.
