1. In John Locke’s Natural Theory Law “Everyone is born with the right to life, liberty, and to accumulate property. The government cannot exist without the consent of the govern people.” The phrase Life is the theory that everyone has the right to live. The government can only take that away after a fair trial. Liberty is your freedom, to be able to do whatever you please as long as you are not in violation of the law. Should someone become in violation of the law, then society can take away your liberty. Property is everyone has the right to own or acquire property, as long as the individual’s property was not gained illegally. The Pursuit of Happiness is just what it says individuals have the right to proceed along with or attempt to gain happiness. The Consent of the Governed is the government cannot exist without the consent of the people. The Right to revolt or overthrow the Government means if government violates 1 or 2 then the people have the right to go against the government. This relates to the civil liberties and rights because it is embodied in the Declaration of Independence “that all men are created equal, that they are given certain rights, among these are Life, Liberty and the Pursuit of Happiness”.
2. Individual rights are the ordinary people, now society, the government, and/or the police represent the group rights. An example of tension between individual and group rights relating to the civil rights would be the case of Carroll v. United States (1925). The 4th Amendment is protects citizens against unreasonable searches and seizures. In this case a search to someone’s automobile was done without a search warrant.
3. I believe it is important for criminal justice professionals to be aware of the civil liberties and rights of all persons because these rights are given to the people by the constitution.
