Running head: AN OVERVIEW OF STALKING

Cyberstaking Overview and Laws

Respected Commissioner:
Due to the recent increase in cyberstalking cases I would like to present an overview of cyberstalking, summarize the laws of our state and discuss a potential cyberstalking case that has been presented to me. By doing so I would like to shed a light on the growing necessity our state has regarding this matter as well as to extend a much needed help to our residents, when it comes to such crimes
Cyberstalking has been defined as, the use of the internet or other electronic device such as a computer, a facsimile machine, a pager, a cellular phone, a video recorder or other electronic means to stalk or harass an individual, a group of individuals, or an organization. It may consists of false accusations, monitoring, making threats, identity theft, damage to data and equipment, the solicitation of minors for sex, or gather information to harass. The definition of “harassment” must meet the criteria that a reasonable person, in possession of the same information, would regard it as sufficient to cause another reasonable person distress.
Based on the above mentioned description of cyberstaliking I would like to present a solution to the case that I was assigned belonging to Cynthia Simmons and go in depth of why legally I believe she does not have a case. This consists of the following e-mails sent to a 23 year old woman by the name of Cynthia Simmon, which believes were sent by her ex-boyfriend age 29 by the name of Jacob Myers.
