Blue Star Services & Logistics (BSSL) is a multinational corporation that owns ships or cruise liners that are flagged in the Bahamas and Liberia. There are law implications that are both public and private under the “Flag of Convenience”. The flag of convenience or what is also known as Foreign Registries can be utilized by companies that own ships or cruise liners. This would allow for example companies to fly a flag of a country that may have lower standards, when it comes to liabilities. A ship is subject to liability as if it were “within” the country whose flag it flies. The laws of these countries can be advantageous rather than tedious or burdensome than under American law. These are entities within various countries that may favor or cater to Americans. BSSL’s passenger tickets and contracts reference that claims that are made by passengers or employees are to be litigated in and under the law of the country whose flag the ship in question flies. BSSL has been presented with legal documentation from Mrs. Lowell’s counsel. This documentation states the incident as well as various charges against BSSL with expectation of a stated monetary payout. Upon BSSL’s review, various issues will be discussed such as A) The ramification of public and private law B) The legalities if the incident happened at BSSL resort on the US Mainland C) What should BSSL do for Mrs. Lowell and in terms of developing policies for future criminal incidents D) What recourse does BSSL have as the employer of Mr. Lowell.
