Employment Law Kimberly Ward University of Phoenix Employment Law Employment law is a broad area of law that covers different aspects of the relationship between employees and employers. Employment law consists of Federal and state statues, judicial decisions, and administrative regulations. Employment law is necessary to operate any business. This paper will describe the history and evolution of employment law. While working at American Home Shield, my husband was in a terrible car accident. As a result, he broke his neck. He was not able to do anything and needed assistance. I took advantage of the Family and Medical Leave Act. My employer provided me with the paperwork that his doctors needed to complete. Once the doctors completed the paperwork, I returned them to the Human Resource Department. Human Resource looked over the paperwork and signed off on it. I was granted FMLA due to the provisions outlined in the Family and Medical Leave Act. While I was out on FMLA, my employer retained my position with the company. According to Cheeseman (2007), Section 2 of the Restatement (Second) of Agency defines an independent contractor a person who contracts with another to do something for him who is not controlled by the other nor subject to the other’s right to control with respect to his physical conduct in the performance of the undertaking. Independent contractors are not considered as employees. Therefore, companies are not obligated to offer much of anything when they hire independent contractors. Companies don’t have to withhold taxes or offer benefits. Contractors are hired to complete a certain task. Once that task is completed, the obligation to one another has ended. Since independent contractors are not considered as employees, they are not allowed to take advantage of the Family and Medical Leave Act.
