“The surge in pregnancy complaints makes it the fastest growing type of employment discrimination charges filed with the EEOC, even as the birth rate has been declining.” (Armour, 2005) There are several different types of issues, situations, and conflicts which occur with pregnant women, there are also stereotypes that have been placed with pregnant women. Some of these stereotypes are that pregnant women are not mentally and physically sharp or that they are not able to give the same worth to the company because they are starting a family or changing their life. In this paper a situation of pregnancy discrimination will be discussed and analyzed as well as the legal actions that were taken to handle or resolve the situation. There will also be discussed the application of Title VII of the Civil Act of 1964 and the Pregnancy Discrimination Act with a breakdown and analysis of the situation.
In 2002 Mailyn Picker was working for an automobile dealership called Berge Ford in Mesa Arizona. Being at the age of 23 she became pregnant and soon reported her pregnancy to her manager at work. In less than two weeks her supervisor came to her concerned that she would not be safe to drive while she was pregnant and because that was part of her job the supervisor fired Mailyn. "I burst into tears," Mailyn said. "They thought I was not going to be able to do my job. They thought I would throw up or have a cramp. But pregnant women work every day. It just wasn't fair." Mailyn reported the discrimination act to the EEOC where they filed a lawsuit on her behalf. Her case went through the processes of suit and was settled out in court for $70,000.(Armour, 2005)
Discrimination like this one is committed on a regular basis although often times isn’t reported or filled with the EEOC because of the lack of knowledge of discrimination laws or rights. Pregnancy should be treated the same way...
