In a series of recent decision courts have begun to wrestle with how defendants use of the internet impacts personal jurisdiction. Those efforts, which have yielded differing results, have also broadcast clear warning signs. If your company uses the internet to conduct business or advertise, or simply maintain a website, those internet activities are recognized as doing business and will be considered when a court decides whether to exercise. Today, many websites or in the middle spectrum with the jurisdiction over the internet which is getting more attention, many websites have turned to the middle in hope of not getting pulled into personal jurisdiction of the internet. Why is personal jurisdiction an issue for those who post websites? – The internet introduced as easier access to the global economy represented significant opportunities there is a thin line between interactive and passive use of websites.
