The Jurisdiction.

The Court has (for compliance) a great number of instruments received. For example, the European Commission start a proceeding to the Court as members of the European rules are not properly maintained, after which the Court a fine or penalty can be imposed. Nor can the Court launched a procedure to decide on European authorities to annul it.
The Court also determines what is the correct interpretation of European legislation (so-called preliminary rulings). This procedure is designed to ensure that national judges Community explain in different ways. In some cases a judge of a EU-member-state can (or should) have a question for the Court to impose. The ruling is binding.

Het Hof heeft voor naleving een groot aantal instrumenten gekregen. Zo kan de Europese Commissie een procedure starten bij het Hof als lidstaten de Europese regels niet goed handhaven, waarna het Hof een boete of dwangsom kan opleggen. Ook kan bij het Hof een procedure gestart worden om besluiten van Europese instanties nietig te verklaren.
Daarnaast bepaalt het Hof aan wat de juiste uitleg is van Europese regelgeving (zogenaamde prejudiciële beslissingen ). Deze procedure is bedoeld om te voorkomen dat de nationale rechters het gemeenschapsrecht op verschillende wijzen uitleggen. In sommige gevallen kan (of moet) een rechter uit een EU-lidstaat een vraag aan het Hof voorleggen. De uitspraak van het Hof is bindend.
